PAIA Manual

This manual is published in terms of Section 51 of the Promotion of Access to Information Act, 2 of 2000 (PAIA), and describes how MDB Chartered Accountants makes information available on request.

1. Note on Exemption

The Information Regulator has, by notice, exempted certain categories of private bodies — including many small businesses and sole proprietors — from the obligation to compile and submit a Section 51 manual. MDB Chartered Accountants nonetheless publishes this manual voluntarily, in the interest of transparency toward clients and the public.

4. Records Held by MDB Chartered Accountants

In the ordinary course of business, the practice holds records including, but not limited to:

  • client accounting, tax, and financial records held under engagement letters;
  • correspondence with SARS, CIPC, and other regulatory bodies on behalf of clients;
  • internal financial and administrative records of the practice; and
  • records collected through this website, such as contact form enquiries.

Client records are held in strict confidence in accordance with SAICA's Code of Professional Conduct and are not disclosed to third parties except with the client's consent or as required by law.

General information about the practice and its services is freely available on this website, including this manual, our Privacy Policy, and Legal Notice.

6. How to Request Access to Records

A request for access to a record must be made in writing to the Information Officer, using the prescribed form under PAIA where applicable, and must provide sufficient detail to enable the record to be located. Prescribed fees may apply in accordance with the PAIA regulations. Requests should be directed to mdbsa@icloud.com.

7. Grounds for Refusal

Access to certain records may be refused on grounds set out in PAIA, including but not limited to the protection of third-party personal information, legal privilege, and commercial confidentiality.

8. Information Regulator

If you are dissatisfied with the outcome of a request, you may lodge a complaint with the Information Regulator of South Africa at inforegulator.org.za.
